For anyone who is having troubles with this here is how to do it:

1. Go to www.yourdomain.com-co.uk/admin.php
2. Click Your Account
3. Edit Terms of Service.

You can also set it so people have to agree they are over 13 by going to:

1. Go to www.yourdomain.com-co.uk/admin.php
2. Users Configuration
3. And tick: COPPA Compliance Required
